These Terms & Conditions (“Terms”) govern your use of Braintiva (the “Service”), a gamified, curriculum-aligned learning platform for Australian primary school students (Foundation to Year 6).
By creating a parent account and ticking “I agree to the Terms & Conditions”, you enter a binding agreement with the operator of Braintiva (“we”, “us”, “our”).
1. Who these Terms apply to
1.1 The Service is designed for parents and legal guardians who manage learning for children in primary school.
1.2 You must be 18 years of age or older and have authority to create accounts and learning profiles for the children you enrol.
1.3 Student logins are created and supervised by you. Students must not create parent accounts.
2. Accounts and student seats
2.1 Parent account. You register with your first name, last name, email address, and a password. Your email is your login identifier.
2.2 Student seats. You may create one or more student profiles (seats). For each seat you provide the student’s first name, last name, a username, a password, and the student’s current school year level and curriculum context (for example ACARA, VCAA, or NESA).
2.3 You are responsible for:
- keeping parent and student passwords confidential;
- all activity under accounts you create;
- ensuring information you provide is accurate and up to date;
- supervising your student’s use of the Service.
2.4 You warrant that you are the parent or legal guardian of each student for whom you create a seat, or that you have lawful authority to enrol that student and to provide their personal information.
3. Acceptable use
You agree not to:
- share accounts or passwords with people who are not members of your household learning team;
- attempt to scrape, copy, or redistribute question banks, quest content, or other proprietary materials;
- upload or generate harmful, illegal, or abusive content;
- interfere with the security, availability, or integrity of the Service;
- use the Service for any purpose other than personal or family educational use as intended.
We may suspend or terminate access if we reasonably believe these Terms have been breached.
4. Private Beta testing
4.1 Braintiva is currently a private Beta test service. Access is limited to invited testers and is provided so families can try early features and help us identify problems before a broader release.
4.2 Beta features, learning content, question coverage, scores, progress displays, rewards, and availability may be incomplete, contain errors, change without notice, or be removed. The Service may be interrupted while we test, repair, reset, or update it.
4.3 We take reasonable steps to protect stored information, but a Beta service may experience defects or data loss. Do not use Braintiva as the only record of important educational progress, and do not rely on it for official assessment, school reporting, health, safety, or emergency decisions.
4.4 You may report issues or suggestions through Contact Us. Do not include unnecessary sensitive information in feedback. We may use feedback to test, fix, and improve the Service, without an obligation to implement a suggestion or compensate you.
4.5 We may pause or end the Beta, withdraw an invitation, limit capacity, or reset test features where reasonably necessary for security, maintenance, compliance, or product development. We will give reasonable notice where practicable.
5. Subject Offerings, free Beta access, and future billing
5.1 Curriculum access is provided as Subject Offerings (Subject × Grade × Authority) and optionally as bundles, assigned to a specific student seat.
5.2 During the private Beta, available Subject Offerings and their available sample questions are provided free of charge. “Available” means the offering has enough reviewed or staged content to be enabled in the marketplace; incomplete packs may remain unavailable.
5.3 We do not collect card payments for Beta access and will not charge you retrospectively for Beta use.
5.4 We may introduce paid plans or prices after the Beta. Any future charge will be clearly shown before purchase and will require a separate action or agreement from you. Continued free access to every offering is not promised after the Beta.
5.5 Practice and retakes on an unlocked Beta offering are included without a per-retake fee.
6. Intellectual property
6.1 Braintiva, its branding, software, question banks, media packs, and related materials are owned by us or our licensors.
6.2 Curriculum alignment (for example references to ACARA, VCAA, or NESA learning areas) does not mean those authorities endorse Braintiva, and does not transfer ownership of official curriculum documents to you or to us beyond fair use or permitted citation.
6.3 You may use the Service for your family’s learning. You may not copy, republish, scrape, or commercially exploit our question content without written permission.
7. Educational nature and content limitations
7.1 Braintiva is an educational practice tool. It is not a school, registered training organisation, or substitute for professional teaching, assessment, tutoring, or wellbeing services.
7.2 Quest scores and progress indicators are for practice and family coaching. They are not official school grades or a complete measure of a student’s ability.
7.3 Some practice content may be assisted by automated or artificial-intelligence tools and then reviewed or tested progressively. Content may still contain mistakes, unsuitable difficulty, or imperfect curriculum alignment. A parent should supervise use and report questionable content.
7.4 To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted availability, complete subject coverage, particular learning outcomes, or that content is error-free.
8. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot be excluded. Where our liability can lawfully be limited, we limit it to re-supply of the Service or payment of the cost of re-supply.
9. Limitation of liability
Subject to section 8 and to the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential loss (including loss of data, opportunity, or goodwill) arising from your use of the Service, except to the extent caused by our fraud or wilful misconduct, or as otherwise required by law.
10. Privacy
Your personal information and your students’ information are handled as described in our Privacy Policy and Consent & Privacy Guidelines. By accepting these Terms you also acknowledge that Privacy Policy.
11. Suspension and termination
11.1 You may stop using the Service at any time. To request deletion of your account and associated student data, contact us using the details in the Privacy Policy.
11.2 We may suspend or terminate accounts that breach these Terms, create security risk, or are inactive for an extended period, after reasonable notice where practicable.
12. Changes to these Terms
We may update these Terms by publishing a new version with a new version date. New parent registrations must accept the then-current version. Material changes for existing users may be communicated by email or an in-product notice. Existing Beta testers are not blocked for re-acceptance in this release.
13. Governing law
These Terms are governed by the laws of Victoria, Australia. Courts in Victoria have non-exclusive jurisdiction, without limiting any mandatory consumer protections that apply where you live in Australia.
